What Stat is
Stat is a NursePal product surface for U.S. healthcare staffing market intelligence. It is delivered through these channels:
- Stat for iPhone and iPad — the Stat app distributed through the Apple App Store (bundle id
com.nursepal.stat). - Stat chat — the AI chatbot at /stat.
- Stat MCP server — a Model Context Protocol endpoint at
nursepal.com/mcp/that exposes the same underlying tools to MCP-compatible AI clients (Claude Desktop, Cursor, VS Code, and similar). - Stat MCP sandbox — the form-driven tool playground at /stat/mcp/sandbox.
All three surface market rate estimates, fill probabilities, forecasts, demand momentum, agency/MSP footprint information, and hospital/system directory data, drawing on aggregated public job postings and NursePal’s proprietary datasets. These terms apply to all of them, and they are the end-user license agreement (EULA) for the Stat app. By downloading or using the Stat app, installing the MCP server, calling its endpoints, using the sandbox, or interacting with Stat chat, you accept these terms.
Binding agreement
These Terms of Use are a legally binding agreement between you (individually and on behalf of any entity you represent) and NursePal LLC (“NursePal”). By accessing or using any Stat surface you represent that you have the authority to bind yourself and that entity, and you accept these terms in full. If you do not agree, do not use Stat. Your sole and exclusive remedy for any dissatisfaction with Stat, its outputs, or these terms is to stop using it.
Eligibility and your account
You must be at least 18 years old and able to form a binding contract to use Stat. Stat is a business tool for healthcare staffing professionals; it is not directed to children.
Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for everything done under your account. One account is for one person — do not share logins, and do not create accounts to evade usage caps or access limits. Tell us promptly at support@nursepal.com if you believe your account has been compromised. We may suspend or terminate an account that violates these terms.
Stat is not a clinical system. Do not enter patient information, protected health information (PHI), or any other individual’s sensitive personal data into Stat.
Public information only; analysis, not conduct
Every market figure Stat surfaces — bill rates, pay packages, fill estimates, agency/MSP/VMS attributions, fee observations, facility and system information — is derived from publicly accessible information, principally aggregated public job postings and public records. NursePal does not originate that information, does not control it, and does not verify the accuracy of what third parties publish. Stat’s function is analysis only: it aggregates, summarizes, and estimates from what is already public.
- Outputs describe public data, not actual terms. Figures are directional estimates of what public postings advertise. They are not statements of any party’s actual contracted rates, fees, margins, relationships, or business terms, which are typically confidential and may differ materially.
- Outputs are not indicative of anything NursePal does. Nothing Stat produces reflects, implies, or constitutes NursePal’s own pricing, rates, margins, business practices, vendor relationships, negotiating positions, or conduct, and no output is a statement made on behalf of any staffing agency, MSP, VMS, hospital, or health system.
- No recommendation is an offer or promise. Labels such as “NursePal Market Recommendation” are statistical reference points computed from public postings (e.g., an upper-quartile observation). They are not offers, quotes, guarantees of fill, or advice to pay or bill any particular amount.
Your duty to verify; no reliance; assumption of risk
It is solely your responsibility to independently verify and validate any information Stat provides before using it for any purpose. You agree that (a) you will not rely on Stat’s outputs as your sole basis for any hiring, contracting, pricing, staffing, compliance, or business decision; (b) any reliance you do place on Stat’s outputs is at your own risk; and (c) you assume full responsibility for all decisions, actions, and outcomes — including financial loss — that result from your use of Stat. NursePal has no obligation to update, correct, or maintain any output after it is delivered.
No professional advice
Stat’s answers are not financial advice, legal advice, tax advice, employment advice, compliance advice, or medical advice. Nothing Stat says creates a fiduciary, professional, advisory, broker, or employment relationship between you and NursePal.
Hiring, contracting, compensation, and staffing decisions carry legal, regulatory, financial, and operational implications. Always consult qualified professionals (legal counsel, HR, finance, compliance, your VMS, etc.) before acting on any information Stat provides.
Stat can make mistakes
Stat uses large language models and historical data. It can produce inaccurate, incomplete, outdated, or misleading information — including specific dollar figures, percentile ranges, fill probabilities, and hospital or system lookups. Rates change quickly and sample sizes vary by market and specialty. Always verify rates and information against multiple primary sources before relying on them.
Data sources and freshness
Rate, fill-probability, and forecast estimates are derived from aggregated job postings and may lag the real-time market by hours or days. Hospital and system directory information is sourced from public records and NursePal data and may be incomplete or out of date. Specialties, professions, and locations not commonly covered in the underlying data may produce especially unreliable answers.
Agency, MSP, VMS, and facility names
Stat’s answers may name specific agencies, MSPs (Managed Service Providers), VMS (Vendor Management System) platforms, hospitals, and health systems. Their inclusion is not an endorsement, recommendation, or claim of affiliation. NursePal is not sponsored by, partnered with, or affiliated with any third party named in Stat’s outputs unless explicitly stated. Names appear because they were observed in publicly available job postings or other public sources. All trademarks are the property of their respective owners.
MCP server and sandbox
The Stat MCP server is provided for evaluation and integration in MCP-compatible clients. It exposes the same underlying tools available in Stat chat. The sandbox is a public, email-gated playground for the same tools.
- No SLA. The MCP server and sandbox are offered without uptime, latency, or correctness guarantees. NursePal may change, deprecate, rate-limit, throttle, or remove tools and endpoints at any time without notice.
- Usage caps. The sandbox enforces per-email and per-IP call caps. Exceeding either cap returns an HTTP 402 or 429. NursePal may adjust caps without notice.
- No reverse engineering or bulk extraction. You may not script, scrape, or otherwise programmatically harvest the underlying datasets through the sandbox, the MCP server, or any other surface. The tools are intended for interactive evaluation and per-question use by AI agents.
- No redistribution as a standalone dataset. You may use Stat’s outputs to inform your own decisions and workflows, but you may not republish them as a primary data source, resell them, or hold them out as independently sourced without our written agreement.
Ownership and intellectual property
NursePal LLC owns Stat. NursePal LLC owns all right, title and interest, including all intellectual property rights, in and to Stat and everything in it: its apps, software, source and object code, APIs, tools, prompts, databases, datasets and data compilations, rate, demand and market data, analytics, forecasts, models, reports, outputs, designs, and the names NursePal, Stat and LocumsPal (together, the “NursePal Materials”). The NursePal Materials are protected by copyright, trademark, trade secret, database and other laws. The selection, arrangement and compilation of NursePal’s data is itself NursePal’s proprietary work and confidential trade secret.
Limited license. Subject to these terms, NursePal grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use Stat and its outputs for your own internal business purposes. The license ends automatically if you breach these terms. All rights not expressly granted are reserved by NursePal LLC, and no other right or license is granted, whether by implication, estoppel or otherwise.
Without NursePal’s prior written consent, you may not, and may not help anyone else: (a) copy, download in bulk, republish, sell, resell, license or distribute any NursePal Materials; (b) scrape, crawl or use any bot or script to access Stat or extract its data, other than through an API NursePal licenses to you and within its limits; (c) reverse engineer, decompile or otherwise try to derive Stat’s source code, prompts, models, algorithms or underlying data; (d) create derivative works of the NursePal Materials, or use them or Stat’s outputs to build, train, benchmark or improve a competing product, dataset or artificial-intelligence or machine-learning model; (e) remove or alter any proprietary notice; or (f) get around any access control, usage limit or security measure.
Feedback. If you send NursePal ideas, suggestions or feedback, you assign all rights in them to NursePal LLC, and NursePal may use them without restriction or payment.
Enforcement. Unauthorized use of the NursePal Materials would cause NursePal irreparable harm. NursePal may seek an injunction or other equitable relief, in addition to any other remedy, without posting bond, and may recover its reasonable attorneys’ fees and costs in enforcing this section. This section survives termination of these terms.
Acceptable use
You agree not to (a) use Stat to make automated decisions that affect individuals without human review, (b) attempt to extract or reconstruct the underlying datasets, (c) misrepresent Stat’s output as independent professional advice, (d) use Stat for any unlawful purpose, or (e) bypass the sandbox’s per-email or per-IP caps via throwaway addresses, proxy rotation, or similar. NursePal may rate-limit, log, or block usage at its discretion.
Privacy
Anonymous Stat chat sessions log the IP address, user agent, and question content for abuse prevention and quality improvement. When you sign up via the inline form, we additionally store the email and role you submit.
MCP sandbox. When you submit your email to use the sandbox, NursePal stores that email together with the number of calls you’ve made, the timestamps of your first and most recent call, the IP address(es) we observed, and the user-agent string on your first call. This data is used to enforce the call cap, prevent abuse, and (with your continued use) to send you product updates about NursePal. If you are later given a Stat account, we link the records so the same usage caps apply.
MCP server. Direct MCP calls from your AI client log the request envelope (tool name, arguments, IP, user-agent) for abuse prevention. We do not associate these logs with any email unless you also separately authenticate.
Stat app for iPhone and iPad. Signed-in app sessions store the same account, conversation, and usage data described in the Stat Privacy Policy. The app requests no device location, contains no advertising SDKs, and does not track you across other companies’ apps or websites.
We do not sell this information. See the Stat Privacy Policy for full details, retention windows, and your rights of access, export, deletion, and opt-out; the NursePal platform privacy policy covers the separate nurse and facility marketplace.
Access, and no charge
Stat is an access-controlled product provided at no charge to the users NursePal authorizes. There is no purchase, subscription, in-app purchase, or other payment of any kind in the Stat app, and we do not collect payment or financial information. Access is granted at our discretion for the duration we specify, and we may modify, suspend, or withdraw it — or discontinue Stat entirely — at any time, without liability. Nothing in these terms obliges us to keep Stat, any feature of it, or your access to it available.
Deleting your account
You can delete your Stat account at any time from inside the app at Settings → Account → Delete account, or on the web at Settings → Account. Deletion erases your identifying profile data, revokes every session, and removes your conversations from view. It is permanent and cannot be undone. You can export your account data and conversation history from the same screen before you delete. See the Stat Privacy Policy for exactly what is deleted and what we must retain.
Apple App Store — additional terms
These terms apply to the Stat app obtained from the Apple App Store, and they control over anything inconsistent elsewhere in this agreement as to that app:
- This agreement is with NursePal, not Apple. These terms are between you and NursePal only. Apple is not a party to them and is not responsible for the Stat app or its content.
- Scope of license. NursePal grants you a personal, limited, non-exclusive, non-transferable license to use the Stat app on any Apple-branded product that you own or control, as permitted by the App Store Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing. You may not copy, modify, reverse engineer, decompile, rent, lease, lend, sell, or redistribute the app.
- Maintenance and support. NursePal is solely responsible for providing maintenance and support for the Stat app. Apple has no obligation whatsoever to furnish any maintenance or support services.
- Warranty. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Stat app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any — the Stat app is free of charge, so no purchase price exists to refund. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app.
- Product claims. NursePal, not Apple, is responsible for addressing any claims relating to the Stat app or your possession or use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims. NursePal, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Stat app or your possession and use of it infringes that third party’s intellectual property rights.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the Stat app, including the terms of your wireless data plan.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms as they apply to your license of the Stat app, and upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
- Contact. Questions, complaints, or claims about the Stat app should be directed to NursePal at support@nursepal.com.
No warranty; limitation of liability
STAT IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NURSEPAL AND ITS AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF STAT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NURSEPAL’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO STAT AND THESE TERMS, UNDER ANY THEORY OF LIABILITY, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID NURSEPAL FOR STAT IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the smallest amount permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless NursePal, its affiliates, and their officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of Stat or its outputs, (b) any decision made or action taken in reliance on Stat’s outputs, (c) your violation of these terms, or (d) your violation of any law or the rights of any third party in connection with your use of Stat.
Governing law & disputes
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising out of or relating to Stat or these terms shall be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction. Any claim must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding, and must be filed within one (1) year after the claim arose or be permanently barred. Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the jurisdiction where you reside, or of the right to bring a claim in your local small-claims court where that right applies.
General
These terms, together with the referenced privacy policy, constitute the entire agreement between you and NursePal regarding Stat and supersede all prior understandings on the subject. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remainder will stay in full effect. NursePal’s failure to enforce any provision is not a waiver. You may not assign these terms; NursePal may assign them in connection with a merger, acquisition, or sale of assets.
Changes
We may update Stat’s behavior, these terms, and the underlying data at any time. Continued use of Stat after changes constitutes acceptance of the updated terms.
